This will include mental health and the emotional aspects of decision making when contemplating a career change - be it subtle or dramatic.
Attorney competence, proscribed by Rule of Prof Conduct 1.1, is intrinsically tied to a lawyer's physical, emotional, and financial wellness. A lawyer with a well devised plan for his or her future is more likely to be more fulfilled, thus healthier, better adjusted, and better positioned to provide effective representation to clients. Vermont has written the requirement that an attorney maintain physical, mental, and emotional wellness into their Rules of Professional Conduct. The implications of Rules of Professional Conduct 1.15 - Safekeeping Property, 1.16 - Declining or Terminating Representation 1.17 - Sale of a Law Practice, 1.3 - Diligence, and 1.4 - Communications will be discussed. The report prepared by The National Task Force on Lawyer Well Being, The Path to Lawyer Well-Being: Practical Recommendations for Positive Change, ABA Commission on Lawyer Assistance Program will be drawn from as well.
Incorporated into the program will be a discussion of the aspects of career transition such as exploring possibilities, developing and evaluating options, overcoming internal obstacles, getting alignment from others regarding the plan, and actually making the transition. The panel will address the emotional and practical side of taking calculated risks with one's career and the interrelationship between lawyer-well-being and ethics.
