Privacy’s “Third-party” Doctrine: Initial Developments in the Wake of Carpenter

The courts have been increasingly challenged in recent years in how to apply the Fourth Amendment to technologically innovative approaches to obtaining location information and other private information about individuals. The Supreme Court’s decision in Carpenter effects a significant equilibrium adjustment. This article assesses the basis for this decision, how lower courts have reacted in its aftermath, and how the decision may impact the many related issues the Court identified, but expressly withheld its view on, because the matters were not before the Court on the facts of this case.
