Regulatory Scheme: Idaho Rule of Professional Conduct 7.4 permits lawyers to communicate information regarding certification as long as the lawyer has been certified as a specialist by "an organization which has been approved by the Idaho State Bar" [Rule 7.4]. Communications must also state the name of the certifying organization. The state bar does not directly certify lawyers as specialists, but presumptively recognizes ABA accredited programs. The bar has also approved programs sponsored by the Idaho Trial Lawyers Association. Only Idaho attorneys who have been certified as specialists pursuant to Section X of the Idaho Bar Commission Rules can advertise or refer to themselves as specialists in an area of law.
