Moving Out, Moving In: New Developments in Housing Access in 2013

This breakout session will cover developments in federal case law, including Township of Mount Holly, N.J. v. Mt. Holly Gardens Citizens in Action, Inc., as well as the implications of Title VI of the Civil Rights Act of 1964 in transportation planning and the need to affirmatively further fair housing. Land use planning, transportation, and affordable housing will be tied together by a diverse panel of speakers well-versed in the Fair Housing Act.

St. Johns River Water Management District. This is the 14th Annual Joint Program of the RPTE Land Use Committee and the Section’s Land Use, Planning and Zoning Law Committee.

ABA CLE Showcase Program:

State Attorneys General and the Class Action Fairness Act: Has the Supreme Court Closed the Door on State Attorneys General Enforcement Actions?

The Supreme Court heard arguments in Mississippi ex rel. Hood v. AU Optronics Corp. in November 2013. The case involved whether parens patriae lawsuits filed by state Attorneys General to recover money on behalf of state citizens can be properly moved to federal court under the Class Action Fairness Act (CAFA). Panelists will discuss the scope and breadth of a state’s parens patriae authority, understanding the federalism issues related to removal of the state Attorneys General actions under CAFA and the impact of the Supreme Court’s ruling on multi-state enforcement actions.
