From Model Rule to Court Rule? The Perils, Pitfalls and Best Practices of Rulemmaking for the Legal Profession
State supreme courts are charged with regulating the legal profession, including writing and occasionally amending a variety of rules. What techniques and tactics can make this process work best for the public, the profession, and regulators? How can the state bar and disciplinary counsel help? What about the role of the public? And how should the goals of seeking uniformity, having the best rule and preserving a jurisdiction's well-established standards be balanced? A panel experienced in the process of rulemaking will work through and provide guidance regarding the factors affecting rulemaking for the legal profession.
