This article is based on the author’s presentation at the 38th Annual Notre Dame Tax & Estate Planning Institute.

Much attention is given to the income and transfer tax considerations in preparing and implementing an estate plan, but important nontax considerations can affect the drafting and implementing of almost any estate plan as well.
