Drafting Electronic Discovery Requests

Anytime you are considering using electronic data, discuss with your client the inherent "boomerang effect" of discovery requests and explain that whatever you request of the other party is likely to be asked of him/her. Part of this understanding must include the fact that previously deleted data often can be restored and anything the client has done electronically may be relevant to the underlying action.
