    This program will cover the basic principles of environmental law, with respect to potential liabilities, particularly those arising out of the Comprehensive Environmental Response Compensation and Liability Act (CERCLA) and its amendments.

    Panelists will discuss CERCLA defenses available under the Small Business Liability and Brownfields Revitalization Act, and how defenses can insulate a purchaser from CERCLA liabilities by following certain steps in the acquisition process.

    Other topics will include the legal mechanics of a transaction focusing on common contractual issues and ensuring that the requisite All Appropriate Inquiry is undertaken so that your client may raise all available defenses to CERCLA liability.
