This program will provide an overview of some key issues in criminal antitrust enforcement for both newly admitted and experienced attorneys, and highlight some of the key differences between the Antitrust and Criminal Divisions of the Department of Justice approaches to investigating and prosecuting cartel cases.

Our panel of current and former prosecutors will discuss:

    • Differences between the Antitrust and Criminal Divisions of the Department of Justice approaches to investigating and prosecuting cartel cases

    • Best practices for each stage of a criminal antitrust investigation, including the beginnings of an investigation; determining whether to cooperate; applying for leniency with the DOJ and other jurisdictions; negotiating a corporate plea agreement and the related fines; individual plea agreements and prosecution of culpable employees; and the implications of taking a case to trial

    • Recent developments in criminal antitrust enforcement in the U.S. and abroad, including policy developments at the DOJ regarding the treatment of culpable employees and compliance requirements for corporations; the potential impact of recent FTAIA cases on the DOJ's enforcement over international cartels; and current international cartel investigations highlighting emerging enforcement regimes abroad
