Since September 16, 2012, parties have been able to challenge patents in inter partes review (IPR) and post-grant review (PGR) proceedings. In their first two years of service, IPRs have been wildly popular—parties have filed almost 2,000 petitions, far surpassing recorded expectations.

The proceedings, pegged "death squads" killing "property rights" by some, have also efficiently cancelled claims and patents, with high institution and cancellation rates. But some patent owners have effectively mounted defenses, and have had patents and claims survive review.

In this program, our expert panel will:

    • Examine the patent owner's IPR perspective, discussing some of the more effective means of avoiding cancellation
    • Discuss the importance of the pre-institution Patent Owner Preliminary Response, filing requests for rehearing, responding to an institution decision in a Patent Owner Response, selecting experts, preparing for deposition and oral hearing, filing Motions to Amend, and more.

This program will help practitioners and parties alike understand the best ways to defend important patents from challenge.
