The word "trial" comes from the 12th Century Gallo-Roman triare, meaning, "to separate out (the good) by examination." This book attempts to entertain, explore, and share lessons from this process of examination. Throughout many of these stories and lessons learned, run three general Core Themes:

    1. Know your court.
    2. Tell your story.
    3. Do the right thing.

Author Dan Small has an extraordinary career as a trial lawyer: first as an award-winning prosecutor with the US Department of Justice, based in Washington, DC. In that capacity, he traveled around the country prosecuting cases in the Organized Crime and Racketeering Strike Force, Fraud Section, and General Litigation section. He then served as an Assistant US Attorney in the Public Corruption Unit of the Boston, Massachusetts, US Attorney's office. He later became general counsel for a national healthcare management company, managing and overseeing litigation in over 20 states, and then worked in private practice with offices in Boston and Miami. His cases have included high-profile white-collar criminal matters, complex civil litigation, high-risk witness preparation, internal and external investigations, and a range of other matters.

Dan is also widely recognized for his speaking on and teaching litigation skills, including as a Lecturer on Law at Harvard Law School teaching Federal Criminal Litigation; as a faculty member for Harvard's Trial Advocacy Workshop; and giving highly rated CLEs and other programs on trial advocacy, storytelling, cross examination, witness preparation, and related subjects around the country. He is also a frequent TV, radio, and media commentator on litigation issues, and the creator of two popular podcasts, "Powerful Witness Preparation" and "The Trial Lawyers Handbook."

"As trial lawyers, we all learn from each other," Dan says. "We learn from our failures and triumphs, our mistakes and successes, and our experiences along the way." In this book, he shares all of that and more.

Dan is the author of three other popular ABA books: Preparing Witnesses, now in its fifth edition, Going to Trial, and Letters for Litigators.
