The Second Edition addresses the federal ad state laws and regulations and the legal precedents regarding and defining a labor union's relations with its members and with those nonmember employees for whom it serves as the exclusive bargaining representative. The contributors intend and hope that this edition provides an updated and comprehensive restatement of the law that governs the internal organizations of unions.
It addresses the historical common law origins of member/union relations; the genesis of the relevant federal statutes, primarily the National Labor Relations Act (NLRA) and the Labor-Management Reporting and Disclosure Act (LMRDA). It will examine union financial issues from a variety of angles, including union dues, union officer fiduciary duties, civil and criminal penalties for misuse of union funds and political expenditures. This edition has been updated to include current Internet and email issues that have recently arisen in the context of union elections. There is a comprehensive presentation of the union's duty of fair representation-the union's obligations vis-à-vis the employees it represents regardless of their membership in the organization. Negotiated union-security clauses requiring membership in, or financial support of the union, as a condition of employment. Inter-union relationships including both the parent/subordinate union relations between international and local unions and relations between independent unions. Finally this edition addresses the legal and ethical issues that internal union disputes can present to union attorneys and other representatives, including potential conflicts of interest and issues of privilege.
