This revised 2016 edition includes instructions for all theories of recovery, defenses, and other matters that have particular application to civil antitrust litigation that would be resolved by a jury, including causes of action under Sections 1 and 2 of the Sherman Act; Section 3 of the Clayton Act; the Robinson-Patman Act; as well as issues commonly raised in patent antitrust cases. The majority of the instructions contain notes providing relevant underlying authority. In addition, these instructions indicate differences in the law that are related to the circuit in which the case is being tried. There are seven major sections and each includes separate causes of actions and elements instructions with a listing of all that require proof. There are also separate instructions on the proof required for each applicable defense. The book also contains cross-references that are common to various causes of action.
