LAWYER'S USE OF MEDICAL-LEGAL CONSULTING FIRM (November 7, 1987) Whether a lawyer may recommend that a client contract, either on a contingent or straight fee basis, with a medical-legal consulting firm and whether the lawyer may cooperate with the firm with which the client contracts depends upon all facts and circumstances, but such an arrangement with the medical-legal consulting firm may raise a variety of ethics questions for the lawyer. These include the reasonableness of the lawyer's fee, possible improper inducements to expert witnesses, restrictions affecting the lawyer's obligations to future clients with respect to selection of expert witnesses, preservation of the lawyer's ability to exercise independent judgment and possible questions of champerty.
