Perhaps no topic is of greater concern to real estate attorneys today than foreclosure law and how it is regulated in each state. The Section of Real Property, Trust and Estate Law is in the process of completely updating and revising its book Foreclosure Law and Related Remedies: A State-by-State Digest, and expects to publish in print all 50 states and the District of Columbia in early 2010. However, to make this information available as soon as possible, five bundles of chapters will be released as downloadable PDF files on a rolling basis during 2009.This new edition of Foreclosure Law and Related Remedies contains a summary of the important aspects and remedies of foreclosure law by state, as well as the significant remedies and laws related to foreclosure including bankruptcy law. Each summary is patterned after a uniform questionnaire, making it easier for you to compare information from state to state. Summary discussions include:
  • The foreclosure process in the state
    1. Notice of default/acceleration
    2. Limitations on procedure and enforcement
    3. Judicial and nonjudicial foreclosures
  • Appraisals
  • Enforcement of guarantees/carve-outs from exculpation
  • Revenue capture prior to foreclosure
    1. Assignment of rents
    2. Receiverships
    3. Sequestration of rents
    4. Escrows and letters of credit
    5. Temporary restraining orders
  • Perfection of the assignment of rents
  • Deeds in lieu of foreclosure
  • Taxes
    1. Property taxes
    2. State and local conveyance taxes
  • Bankruptcy considerations
  • The chapters in this comprehensive, easy-to-understand guide will aid attorneys in private practice, in-house counsel who represent multistate lenders or developers, or who represent purchasers in bulk sale of multistate mortgage loans. It contains pertinent information useful at the time of enforcement of a mortgage loan and default, or during a loan workout, where it will help practitioners assess alternatives that a lender may consider as part of the due diligence process undertaken prior to a purchase from a bulk sale of mortgage loans.
