PROGRAM INFORMATIONIn this economically uncertain environment, investment selection is more important (and more confusing) than ever. Trustees have the additional responsibility of understanding and conforming to the Uniform Prudent Investor Act ("UPIA"). This puts their attorneys in the unenviable position of advising trustees to develop a plan, consistently follow it and not be swayed by the emotional impact of these extremely volatile markets. This program will help the estate planning attorney determine how to advise clients on the law of investing without giving investment advice. This session will discuss:
    • The law of investing as codified in the UPIA;
    • The case law that has developed from the UPIA;
    • The emotional impact on investment decisions as a result of "behavioral finance" concepts;
    • The implications of hindsight bias and the so-called curse of knowledge;
    • The attorney's professional responsibility in providing UPIA advice;
    • The attorney's role in determining investment strategies.
