    Participants will develop an understanding of the unique needs, issues and concerns of families that have a member with special needs, including:

     

    ·         The defining characteristics of intellectual and developmental disabilities;

    ·         The prevalence of cognitive disabilities and most common diagnoses;

    ·         Challenges people with disabilities face with education, employment, housing and support services;

    ·         Avoiding language that is likely to offend potential clients;

    ·         Existing publicly funded benefits, services and supports, and;

    ·         Resources and assistance available from The Arc and other organizations.

     

    Additionally, there is much more to special needs planning than understanding government benefits & the types of SNTs.  The “value added” that an estate planning attorney could… should bring, is to provide the family and/or the individual with special needs, with direction and with guidance to appropriate, available resources.

     

    ·         First, you must “understand” your clients, their concerns, their fears, their desires, and be sensitive to their feelings;

    ·         Second, you must understand your State’s delivery system for services; the available State Medicaid Waivers; and be aware of the available advocacy and service providing agencies related to the specific special needs.  One size does not fit all.  You must understand the nature of the particular individual’s special needs.

    ·         Third, you should be prepared and know when to, and to whom to, refer the individual and/or the individual’s family for such matters as benefit applications, special education law, ADA law, that are not part of your practice.

     

    Our panel will discuss appropriate preparation for that “initial consultation” and suggested topics for the consultation, unique to special needs planning and assisting the family in appropriately educating and informing the “future team”, the future trustees, executors, guardians, care providers, power of attorney agents, etc.
