AI, crypto among topics at ABA white-collar crime meeting

Recent developments related to artificial intelligence, cryptocurrencies, the media and the challenges of judging in the 21st century are on the agenda for the ABA 40th White Collar Crime Institute March 4-7 in Miami. The meeting is sponsored by the ABA Criminal Justice Section.

Leading federal and state judges and prosecutors, law enforcement officials, defense attorneys, corporate in-house counsel and academics will explore myriad white-collar crime issues during the three-day meeting and share insights on topics including recent trends in criminal antitrust enforcement; the new Department of Justice whistleblower program; and lessons learned from high-profile white-collar cases.

Other program highlights:

“The Challenge of Judging in the 21st Century” — This continuing annual judicial panel explores the evolving task of judging in the 21st century. Five noted federal judges, led by retired U.S. District Judge Bernice Donald, will again consider some of the personal and professional challenges and difficult substantive issues they confront in the daily administration of justice.

“Crime Victims’ Rights in Corporate Criminal Proceedings” — This panel brings together legal experts, former government attorneys and victims’ rights advocates to discuss the role of crime victims in federal criminal proceedings. Panelists will explore the legal protections afforded to victims under the Crime Victims’ Rights Act, focusing on the recent corporate dispositions, the challenges victims and the government have in providing victims a voice in the justice process and best practices for government attorneys and the defense bar for addressing victims’ advocacy rights in corporate criminal proceedings.

“Anatomy of a White-collar Crisis: The Interaction Between Legal Strategy and Media Scrutiny in a Corporate Criminal Case” — Experts will examine how the public conversation and media coverage about a white-collar crisis influence legal strategy and guide the decisions counsel must make. Panelists, including a reporter, a communications consultant, a general counsel and a federal prosecutor, will discuss how they each confront the legal and ethical challenges that come with intense public interest in a corporate criminal crisis.

“Inside the World of Legal Punditry: How Does It Impact the Practice of Law?” — Legal pundits have been around for decades, but recently the intersection of law, media and politics has reached a fever pitch that shows no signs of abating. Panelists will discuss how legal punditry has impacted their own practice and how their work as legal analysts has influenced the development of their practice, posed ethical dilemmas and shaped how they present themselves to their clients, colleagues and the legal community.
