ABA Section of Environment, Energy, and Resources hosts spring conference in Denver

CHICAGO, April 18, 2023 — Colorado Attorney General Phil Weiser will deliver the keynote address at 8:15 a.m. on April 27 during the 52nd Spring Conference on Environmental Law hosted by the ABA Section of Environment, Energy, and Resources April 26-28 in Denver.

Weiser’s speech, “Colorado’s Commitment to Protecting the Environment,” will highlight his work to protect the environment and preview what’s ahead. 

Panel discussions feature a broad range of topics, including the future of public land management, legal pathways to climate adaptation, drought mitigation, the latest PFAS litigation and environmental transactional law issues.

Program highlights include (all times are MDT):

“Deflating Emissions and Inflating Resiliency: Implications of the Inflation Reduction Act” – In 2022, Congress passed the Inflation Reduction Act, which, in addition to corporate tax reform and investments in health care, made a historic investment in the clean energy transition to curb carbon emissions and increase resiliency against the existential threat of climate change.

This panel will share insights about the impact of the new law on the fossil fuel and renewable energy sectors, as well as its import for the wider practice of environmental law.
Thursday, 9-10:30 a.m.

“The Jurisprudence of Justice Gorsuch and the Future of Environmental, Energy and Natural Resources Law” – Much can be gleaned about the future of environmental, energy and natural resources law by examining the jurisprudence of Denver’s “native son” and former 10th Circuit judge, Justice Neil Gorsuch. The Supreme Court appears poised to fundamentally upend the underpinnings of environmental regulation, with Gorsuch leading the charge. Gorsuch is an outspoken critic of Chevron and Auer deference and is perhaps the Court’s leading proponent of the nascent non-delegation and major questions doctrines. This panel will explore the nuances and implications of Gorsuch’s jurisprudence in these critical areas.
