CHICAGO, Nov. 18, 2022 — The American Bar Association Section of Dispute Resolution will host its 19th Annual Advanced Mediation and Advocacy Skills Institute Dec. 1-3. The theme of the virtual event is “Learning from the Past, Building for the Future.”
The event, which features leading social, behavioral and legal authorities, will explore new mediation advances that build on pandemic-era discoveries and innovations in technique, delivery and technology. Advocates, practitioners, educators and consumers of Alternative Dispute Resolution services are invited to attend. Plenary sessions will be followed by small group discussions led by experts in the field.
Ken Cloke, director of the Center for Dispute Resolution, will deliver the keynote address, “Mediation in a Time of Crisis,” on Thursday. Keynote speaker Alexandra Carter, clinical professor of law at the Columbia Law School, will discuss “Ask for More: Strategic Negotiation for Legal Professionals” on Friday.

Plenary sessions include:
“Impasse: Management Unpacked! (Pt.1) — Effective Emotional Interventions” — The panel will explore the emotional dimension of impasse, including cognitive barriers to agreement and effective interventions to manage the psychological condition popularly referred to as “amygdala on overdrive,” and identify three of the most pervasive emotional states that mediators find challenging in mediated problem solving, settlement negotiations and peace making.

“Technology in Practice: ODR and More” — After two years of the shift to online practice during the pandemic, most mediators, advocates and clients have a much greater ease and facility with technology than they did before. In fact, in many ways, technology has become an integral part of their daily practice. This panel will cover some of the pros and cons of current technologies and share a peek at some of the tech that is coming in the pipeline.

“Mediation Around the World: Leveraging our Shared Experiences for a Brighter Future” — The global pandemic opened the door to the golden age of virtual dispute resolution. Geographic boundaries no longer exist. Hundreds of countries now have a national law on mediation. Mediation centers are blooming worldwide while mediation training is being offered on an international scale. This panel of international dispute resolution leaders will discuss the rise of mediation around the world, as well as the challenges and opportunities to build a brighter future.
