New ABA book helps lawyers guide clients to assess their interests, risks in litigation

CHICAGO, Jan. 24, 2020Newly released by the American Bar Association, “Litigation Interest and Risk Assessment: Help Your Clients Make Good Litigation Decisions” is a must-read for litigators and mediators who care deeply about their clients and want to assist as they struggle to navigate issues through the legal system.

This guide, sponsored by the ABA Section of Dispute Resolution, is loaded with practical illustrations and checklists to help practitioners recognize and avoid common decision-making errors in litigation; negotiate and mediate more effectively; anticipate likely court outcomes more accurately; and help clients make better decisions;

All stakeholders in the litigation and settlement of lawsuits can make use of this valuable resource. Even the most experienced litigators will gain valuable guidance for effective and ethical practice of litigation and negotiation. The book also is relevant for corporate and government counsel and executives, settlement conference judges and law school faculty and students.

The three authors are experienced in areas of alternative dispute resolution. They are:

  • Michaela Keet, a professor at University of Saskatchewan’s College of Law in Canada, who has taught and lectured extensively in the areas of negotiation and mediation.

  • Heather Heavin, associate dean of Research and Graduate Studies and an associate professor at the Saskatchewan law school. She has focused on international and domestic trade dispute resolution and business law, and more recently on risk assessment.

  • John Lande, who is the Isidor Loeb Professor Emeritus at the University of Missouri School of Law and former director of its LLM Program in Dispute Resolution. He has written extensively on dispute system design, including planned early dispute resolution, among other areas.
