Another Take on Juliana

Rick Reibstein wrote the article “Can Our Children Trust Us with Their Future,” which appeared in TYL’s Fall 2017 issue. With all due respect to the Juliana court and to Rick Reibstein, it is my opinion that in singing the praises of Federal District Court Judge Ann Aiken’s ruling in Juliana v. United States, Reibstein commits even more errors than did the court. In my opinion, the court got the law of public trust wrong and assumed to itself a role not within the constitutional powers of the judiciary. Reibstein endorses the court’s legal mistakes while urging an understanding of the role of the judiciary that would have been unrecognizable to the founders of the American republic.
