Local land use control is not constitutionally guaranteed. States may preempt local regulation to advance a statewide interest. Municipal land use control implicates a statewide interest in addressing housing costs, sprawl, and segregation.

The California Coastal Commission has taken inconsistent paths related to short-term vacation rentals, given the Coastal Act’s mandatory beach access and visitor accommodation goals. New state regulation may be needed to resolve these current issues.
