Forced Waiver of Claims Proves Fatal to Arbitration Clause Under Tribal Law

An arbitration agreement requiring parties to waive federal statutory claims is unenforceable, says the U.S. Court of Appeals. This reminds contract drafters to be cautious when trying to limit the scope of claims available to a claimant in arbitration.
