Amending Rule 8.4 of the Model Rules of Professional Conduct

One of most talked-about resolutions at the upcoming Annual Meeting is Resolution 109. The Standing Committee on Ethics and Professional Responsibility (SCEPR), along with several other entities, is recommending that the ABA include an anti-discrimination and anti-harassment provision in the black letter of the ABA Model Rules of Professional Conduct. The Model Rules of Professional Conduct are promulgated by the ABA as a model for states to use as they establish ethics codes. The House of Delegates will consider a proposed revision to Rule 8.4 that would make it misconduct for lawyers to discriminate or engage in harassment in conduct related to the practice of law.
