Our esteemed panel of Bruce McDonald and Vladislav Ugryumov address the following questions:

  • How do international patent and data exclusivity issues affect the development of vaccines and innovative drugs?
  • What do these international protections and requirements mean for the development of Covid vaccines and therapeutics in the United States and internationally?
  • What measures are being taken, or can be taken, by international organizations and institutions to speed the development of Covid vaccines and therapeutics, and to make them available at a reasonable cost

Bruce McDonald is a partner in the intellectual property group of Atlanta-based Smith, Gambrell & Russell, LLP, working out of the Washington office. As a trademark litigator he successfully defended the American Bar Association in a trademark infringement case. He is also a Russian scholar who attended Leningrad State University in 1976, gave Russian-language presentations in 1994 on behalf of Rotary International at the first Russian Rotary Clubs, represented the Russian Federation in 2011-2012 as amicus curiae in theStolichnaya Vodka trademark litigation at the Second Circuit, and in 2012-2013 was lecturing at Russian universities when he received an invitation to give a presentation at the Russian Supreme Court on the America Invents Act, in commemoration of the newly created Russian Intellectual Property Court. In August 2013 his report was published in the inaugural edition of the Journal of the Russian Intellectual Property Court, www.sgrlaw.com/site/assets/files/3908/4.pdf, and in October 2013 he was the only American (and one of only four Westerners) appointed to the Court's 67-member advisory panel. All of the above led to his collaboration with the featured speaker at our November 18 presentation.

Vladislav Ugryumov, the featured speaker, is a partner in the Moscow office of Gowling WLG, specializing in patent litigation especially in the area of the life sciences. He is widely known as one of the top pharmaceutical lawyers in Russia. In 2017, Messrs. McDonald and Ugryumov were jointly engaged by the Pharmaceutical Research and Manufacturers of America to produce a series of advocacy papers on the protection and enforcement of pharmaceutical patents in Russia. The papers were subsequently published by the top peer-reviewed journals in the fields of intellectual property and international law, respectively, see Compulsory Licensing of Pharmaceutical Patents in the Russian Federation Threatens Foreign and Domestic Drug Developers 46 AIPLA Quarterly Journal 1 (Winter 2018), www.sgrlaw.com/wp-content/uploads/2018/05/..., parallel Russian text atwww.sgrlaw.com/wp-content/uploads/2018/05/...; and Setbacks in Regulatory Data Protection Confront Innovative Drug Developers in the Russian Federation, 51 Int'l Law. 171 (2018), www.americanbar.org/content/dam/aba/administrative/international_law/til_51-2_cpy.pdf; parallel Russian text at www.sgrlaw.com/wp-content/uploads/2018/05/McDonald-Bruce_Regulatory-Data-Protection-Article-Russian-Text.pdf.
