Commercial scale renewable energy development is already big business in the US today. With robust tax incentives included in the Inflation Reduction Act, the pace of investment is likely to increase dramatically. But renewable energy development comes with some significant legal challenges. The panelists in this Professor’s Corner discussion will focus on property and land use issues related to siting renewable energy development. Professor Uma Outka, from the University of Kansas, and Professor Wyatt Sassman, from the University of Denver, will discuss current approaches to regulating these developments, federal laws like NEPA and the IRA that can make these developments harder or easier to accomplish, and the critical role of community engagement.
