Construction law is a significant, complex, and important part of real estate practice, and yet the area remains under-theorized and often overlooked by legal academics. There is a tendency among legal scholars to associate construction law primarily with litigation and dispute resolution, but the construction industry provides some of the most interesting and challenging projects that real estate and finance lawyers handle on a regular basis. The panelists will explore and analyze the gap between the very substantial construction bar and the meager attention the industry receives in the law schools and legal journals and will identify and discuss the most salient transactional issues faced by construction lawyers today.
