The pandemic has complicated all manner of transactions and upset rights and remedies between contracting parties. Moratoria on foreclosures now preclude resort to the most fundamental remedy available to lenders against their defaulting borrowers. Do the moratoria or extra-contractual limits operate to preclude foreclosure of a pledge of an equity interest in an entity that owns real property?
