ABUSE
JURY TRIALS
U.S. v. Gumbs, 562 Fed.Appx. 110 (V.I. Ct. App. 2014). In case where defendant was charged for producing and possessing child pornography and raping his eight-year-old niece, trial court did not abuse its discretion by permitting juror to remain on case. Juror had reacted emotionally with tears to a video of defendant engaging in sexual conduct with his eight-year-old niece. Lower court judge considered the overall conduct of the juror and determined he was capable of performing his duties without bias.
