Social workers violated the Fourth Amendment by removing children from their mother’s home under an Ohio juvenile court standing order that authorized them to remove and provide emergency care and shelter to children who were at risk of serious physical or emotional harm and a temporary emergency care order. The orders were not comparable to a warrant and were not issued based on a finding of probable cause. There were also no exigent circumstances to justify removal without a warrant.
