In suit against child’s elementary school teacher for alleged abuse of their daughter, parents alleged sufficient facts to state claim under 14th Amendment and satisfied “conscious-shocking” standard; parents stated facts sufficient to overcome teacher’s claim for qualified immunity by showing student had constitutional right to be free from excessive force and teacher’s conduct was malicious and conducted in bad faith.
