Absent any blockbuster healthcare fraud settlements in FY2023, a few procurement matters have stolen the False Claims Act (FCA) spotlight—at least for a moment. In July, the Department of Justice announced a $377 million settlement with Booz Allen Hamilton, resolving a whistleblower’s allegations that the company had improperly charged its government contracts for expenses associated with its commercial business. In September, the United States reached a $4.4 million FCA resolution with Navmar Applied Sciences Corporation stemming from claims of double-billing labor and shifting incurred costs among the company’s various Navy contracts. Both matters illustrate the technical cost and pricing issues that can become stumbling blocks for contractors, along with the unique procedural and litigation challenges that are part of any FCA investigation and resolution. Our next session (60 minutes of discussion, followed by Q&A and networking) will explore the insights and practical pointers of attorneys and accounting experts who have tackled these issues and come out on the other side.
