Are Changes Coming Soon to Rule 11 Sanctions?

Rule 11 amendments would mandate sanctions, including attorney fees and costs, for frivolous lawsuits.

Legislation currently pending before Congress seeks to amend Rule 11 of the Federal Rules of Civil Procedure to make sanctions mandatory for attorneys, law firms, and parties that violate Rule 11. The U.S. House of Representatives recently passed the federal Lawsuit Abuse Reduction Act of 2017, H.R. 720, with its companion measure, S. 237, currently pending action before the Senate Judiciary Committee.
