In a decision with broad ramifications for insurance bad faith cases, the Pennsylvania Supreme Court has issued a decision that, for the first time, endorses a test for bad faith. In doing so, the Supreme Court rejected a call to impose a requirement that the policyholder prove that the insurance carrier prove ill-will.
