Learning the Court <i>de Novo</i>

How to prepare for any judge at oral argument.

As any appellate advocate knows, oral argument preparation is essential. But it’s not enough to know the facts and the law. An effective advocate must also know the court. She should know which judges might favor her view of the law and which judges are likely to disagree. That knowledge, after all, can be essential given the limited time that an oral advocate has to stand in front of three judges and attempt to persuade.
