Fifth Circuit Upholds Order to Proceed with Maritime Arbitration in London

This decision will allow parties to evaluate whether an order concerning arbitration can be considered “final” and therefore subject to appellate jurisdiction.

On January 9, 2019, in Psara Energy, Ltd. v. Advantage Arrow Shipping, et al., ___ F.3d ___, 2020 WL 104348 (5th Cir. 2020), the U.S. Court of Appeals for the Fifth Circuit dismissed the Advantage Defendants’ appeal seeking to overturn the district court’s order granting a motion to refer a charter party dispute to arbitration in London. This decision will allow parties to evaluate whether an order concerning arbitration can be considered “final” and therefore subject to appellate jurisdiction.
