Mission

The Professional Liability Litigation Committee provides a forum for litigators who prosecute or defend claims and regulatory proceedings against attorneys, accountants, and directors and officers to inform themselves on recent developments and hot topics in the area of professional liability. Active subcommittees include accountant liability, attorney liability, social media, and young lawyers.

Message from the Chairs

As many of you know, Ed Marod and I are co-chairs of the Professional Liability Litigation Committee of the ABA Section of Litigation. On Friday, I attended the ABA Section of Litigation Winter Leadership Meeting. I wanted to provide some updates. Also, I will post this on Communities. Please let me know if you have any thoughts or want to volunteer to write an article or practice points for our upcoming newsletter that we hope to publish in March or have an idea.

Ed and I are trying to expand membership in our Committee. Please encourage members of your firm or other colleagues to join the Section of Litigation and also the Professional Liability Litigation Committee.

We are looking for 2-3 Practice Points. Practice Points are short, substantive pieces of 100-750 words on substantive, current topics in the areas of Accountant’s Liability, Attorney’s Liability, or Directors & Officers Liability. However, more general topics relating to litigation practice may also be of interest to our committee members. (See attached). Please let Ed or I know if you want to volunteer to write a practice point for the upcoming newsletter (we would need to receive it by the end of February) or the next newsletter that we intend to publish in September.

We are looking for 1-2 Articles on topics in the areas of Accountant’s Liability, Attorney’s Liability, or Directors & Officers Liability. Articles are longer substantive pieces of 750 to 2,500 words. (See attached). Please let us know if you want to volunteer to write an article for the upcoming newsletter (we would need to receive it by the end of February) or the next newsletter that we intend to publish in September.

We are looking for 2-3 Sound Advice Recordings. A Sound Advice is a no more than ten-minute recording featuring tips on trial practice strategies, business development, professionalism and other topics, including the focus of our Committee on the three areas of Accountant’s Liability, Attorney’s Liability, or Directors & Officers Liability. You can record a Sound Advice on your smart phone and then email the file to Ed Marod or me. We will transmit it on to our ABA liaison who will post it on our Committee webpage.

We are looking for volunteers to put on a Roundtable event. Roundtables are an hour or less in length and can feature one or more speakers on a particular topic. Ed and I can assist in working with the Section to put on the Roundtable and publicize it within our Committee and to other Committees in the Section who might have an interest in the topic. Please reach out to us if you have an idea or want to learn more.

The Section of Litigation Annual Conference will be in Washington, D.C. this year. The Annual Conference will be at the Capital Hilton May 1-3, 2024. The Conference brings together attorneys from around the country in private practice and public sector practice. The conference provides interesting programs on trial advocacy, litigation strategy, and case management and is a great opportunity to network. Our committee will be having a dine-around (possibly jointly with another committee) on the evening of May 1. More details to follow. Please let us know if you are interested so we can place you on the list.

If you are interested in becoming involved in the leadership opportunities within the Committee or within the Section as a whole, applications are open and the deadline to apply is in March. Please let us know if you have any questions.
