Judge Bailey has been on the District Court bench since his appointment and confirmation in 2007. He graduated from Dartmouth College in 1973. After serving as a federal law clerk from 1976-78, John engaged in the private practice of law from 1978-2007. He is a Past President of both the West Virginia State Bar and the West Virginia Bar Association. He is a Fellow of the West Virginia Bar Foundation and the American Bar Foundation.

He served as West Virginia State Delegate from 2013 to 2021. He has served on the Committee on Constitution and Bylaws. He currently is a member of the Judicial Conference of the United States, having been elected by the district judges in the Fourth Circuit.

Judge Bailey is married to Cynthia R. Nixon, a hospital finance consultant, and has four children and eight grandchildren.
