Employment Law Implications After the Supreme Court's Ruling on Affirmative Action in Higher Education

In June 2023, the U.S. Supreme Court, in Students for Fair Admission v. President and Fellows of Harvard College, held that using race as a criterion in admissions violated the Equal Protection Clause of the Fourteenth Amendment. While not directly applicable to the workplace, the decision spawned an increase in challenges, both legal and political, to affirmative action and DEI efforts in the workplace. Panelists will discuss the public and private employment law implications, new and current legal challenges to diversity, equity and inclusion efforts, affirmative action in workplaces, and useful efforts to continue to create equal employment opportunity.
