“Insanity is doing the same thing over and over and expecting different results.” No doubt Albert Einstein's famous one-liner has crossed the mind of many judges frustrated with the usual script for handling criminal and juvenile cases: (1) What law was broken?, (2) Who broke it?, and (3) What punishment is warranted? In this process, do we squander scarce resources on some cases and defendants who may not need them?
