Section 337 at the US International Trade Commission (ITC): Patents and Beyond

While Section 337 investigations at the ITC frequently involve claims regarding utility patents, other forms of unfair competition involving imported goods may also be asserted under Section 337. Therefore, the ITC is becoming an increasingly popular venue to address intellectual property infringement claims. Procedures, remedies, injury requirements in such infringement cases, and key characteristics of using the ITC as a potential venue will be discussed and explored.
