The ABA-IPL Section is partnering with three well-known Chicago IP law firms and the Intellectual Property Law Association of Chicago (IPLAC) to bring you intellectual property law specific CLE programs that will provide perspectives on what’s on the horizon for IP law.

 

These programs will feature new developments and emerging issues in patents, trademarks and global environments. A networking reception will follow the session in each of the three program locations.

NEW HORIZONS: The Future of Trademark Disputes at the TTAB and the Courts

The focus of this program will be to discuss the issues that trademark owners need to consider when deciding to institute opposition or cancellation proceedings before the Trademark Trial and Appeal Board (TTAB) and/or trademark infringement, unfair competition, counterfeiting and dilution actions in federal courts. A panel of trademark law experts will address, among other things: (1) the implications of the potential preclusive effect of TTAB decisions under the U.S. Supreme Court's 2014 decision in B&B Hardware, Inc. v. Hargis Industries, Inc., (2) options for early resolution of disputes in federal court and the TTAB; (3) scope of relief, cost, timing and jurisdictional considerations when considering trademark infringement and related actions in federal court or proceedings before the TTAB; and (4) anticipated procedural developments at the TTAB, such as streamlined non-use cancellation proceedings.

NEW HORIZONS: Achieving Success at the PTAB in the Wake of the New Regulatory and Decisional Climate

The Under Secretary of Commerce for Intellectual Property and Director of the USPTO has publicly stated that the PTAB has a perception problem. This CLE program will explore the “ins” and “outs” of this statement, if there are actual problems, what they might be, and how they should be remedied. Changes the PTAB is currently making to improve its public perception will also be covered, including regulatory reform (changes to the claim construction standard), motions to amend, rehearings, expanded panels, and partial institutions. In addition, the panel will discuss current publicly released proposals and proposals that may be proposed going forward.
