Permissible Restrictions on Freedom of Peaceful Assembly under the United States Constitution and International Law

This report analyzes freedom of association and assembly rights regarding access to foreign funding. U.S. and international law protects the fundamental right to freedom of peaceful assembly and only allow for restrictions on this right that are narrowly tailored to serve a compelling interest. This memorandum will begin with a discussion of the right under U.S. law and then will examine the legitimate restrictions allowed under international law.
