On August 26, 2024, the Council for the ABA’s Section of Legal Education and Admissions to the Bar issued a proposed revision to the ABA’s diversity and inclusion standards for law school admissions and hiring after receiving dueling letters from two groups of state attorneys general in the wake of the Supreme Court’s Students for Fair Admissions v. Harvard decision. The proposed revisions to Standard 206, formerly titled “Diversity and Inclusion” would strip DEI criteria and language out of the Standard. The new draft will now proceed to notice and comment.
