The O’Neill Institute at Georgetown University recently flagged a notable 11th Circuit No Surprises Act case, REACH Air Medical Services LLC v. Kaiser Foundation Health Plan Inc. (No. 24-10135). In the case, an IDR arbitrator ruled in favor of the insurer, Kaiser Permanente, and the out-of-network air ambulance provider challenged the arbitration award in federal court. The provider lost at the district court level and has appealed to the 11th Circuit. Here are links to KP’s Appellee Kaiser Permanente’s Brief and AHIP’s Amicus Brief.
