On May 8, 2024, the U.S. House Ways and Means Committee favorably referred the Ensuring Seniors’ Access to Quality Care Act to the full House of Representatives. If passed, the Act would allow nursing homes to continue operating onsite nurse aide training programs despite certain deficiencies, as long as the deficiencies are not directly related to resident care. Sections 1819(f)(2) and 1919(f)(2) of the Social Security Act currently require a mandatory suspension of onsite nurse aide training programs if a facility has been subject to specified regulatory actions. The Act would provide more flexibility for training nurse aides, which is positive news for providers in light of the current staffing shortage and forthcoming federal staffing mandate.
