As reported previously in HLBytes, the district court judge in Braidwood Management Inc. v. Becerra held that requiring private insurers to provide preventative health services without cost sharing as required under the PPACA was unconstitutional. The federal government appealed this decision and on May 15, 2023, the U.S. Court of Appeals for the 5th Circuit issued an administrative stay of the district court’s ruling. On May 19, 2023, the 5th Circuit calendared oral argument on the stay motion for June 6, 2023, at 3 pm CT.
