Lawyers Earn Judge’s Rebuke for Attempting to Condition Consent to Stay Litigation following Premature Birth of Opposing Counsel’s Child

In a heated sexual harassment suit in the Southern District of New York, a district judge ordered an unconditional three-week adjournment allowing the plaintiff’s lawyer time with his family after his child’s unexpected early birth.  Opposing counsel had demanded five conditions for their consent to the requested stay, including insisting that the plaintiff’s attorney first file a response to a motion to dismiss.  Three of the demands related to different clients arbitrating cases against the same defendant.
