Jury Rejects Federal Government Ownership of Drugs Used to Prevent HIV

The New York Times reports that on May 9, 2023, a Delaware federal jury in an unusual patent infringement case rejected the federal government’s claims of ownership of lucrative drugs Truvada and the newer Descovy.  These drugs are used to prevent H.I.V. and are sold by pharmaceutical company Gilead Sciences.

Activists and the government had asserted financial and legal rights to the medicines because they were developed with support from public funding.
